SPANISH NATIONALITY FOR INTERNATIONAL VOLUNTEERS AND THEIR DESCENDANTS: DEMOCRATIC MEMORY LAW
The new Law of Democratic Memory was created with the aim of vindicating the victims of the Spanish Civil War and the Franco regime. This law allows access to Spanish nationality in certain cases, one of them being that of the volunteers who were members of the International Brigades in the Spanish Civil War and their descendants. This is in recognition of the defence of freedom and the democratic principles for which they fought.
"For the purposes of Article 21.1 of the Civil Code, it is understood that exceptional circumstances apply to the volunteers of the International Brigades who participated in the War of 1936 to 1939 for the acquisition of Spanish nationality by letter of nature, not being applicable to them the requirement of renunciation of their previous nationality required in Article 23.b) of the Civil Code. Likewise, the same circumstances shall be understood to apply to the descendants of volunteers who can prove that they have continued to work to disseminate the memory of their ancestors and defend democracy in Spain".
It is important to highlight that, in this particular case, Spanish nationality is obtained without having to renounce their current nationality and without having to take a Spanish language test, requirements necessary in other cases of recognition of Spanish nationality.
Therefore, volunteers and descendants of volunteers who can prove that they have worked continuously to spread the memory of their ancestors and defend democracy in Spain will be eligible for dual Spanish nationality.
We are talking about more than 32,000 brigadiers who fought for democracy, many of whom, between 9,000 and 10,000, left their lives on the battlefields.
Volunteers from 50 countries came to Spain to join the international brigades, including France, Italy, the United Kingdom, the United States, Canada, Poland and Germany, among others.
